Recent amendments in 2014 to the Minnesota Statutes regarding custody and parenting time resulted in some important changes for practitioners, primarily when addressing ongoing changes to parenting time. One significant amendment to Minnesota Statutes §518.17, subdivision 2, is that there is no presumption for or against joint custody, except in cases of domestic abuse. Other amendments to Minnesota Statutes §518.175 provide for modifications to parenting time in the children’s best interests and that the court may modify parenting time to meet the children’s changing development needs.
