Pending Changes in TCPA Compliance
The Telephone Consumer Protection Act has become one of the most litigated violations of federal law. Circuit courts have split over the last few years on what qualifies as an automatic dialer (smart phones qualify?!), whether a single call to an erroneous number counts as a violation, what companies must do to update their database of consensual numbers, and whether the TCPA violates the First Amendment for regulating content-based speech. This presentation will discuss the cases pending before the Supreme Court, discuss best practices while the cases are pending and make some predictions on potential outcomes from the Supreme Court and the impact it may have on telecommunications companies.
