Timothy L. Gustin, Attorney


In his practice of real estate law, Timothy L. Gustin provides a depth of experience in deal structuring, efficient execution, and confident and direct management of the deal. He draws upon his network of contacts and a collaborative approach to close real estate transactions across the United States. His diverse real estate experience spans the following areas:  

Multifamily Agency Lending - Freddie Mac and Fannie Mae

Tim heads Moss & Barnett’s team of multifamily agency lending professionals. Through his leadership, Moss & Barnett has become one of the leading law firms nationally in representing Freddie Mac Program Plus® lenders. This team of attorneys and paralegals primarily focuses on representing lenders who originate and then sell mortgage loans to Freddie Mac or Fannie Mae.

The firm has closed thousands of Freddie Mac transactions in every product line, and Tim serves as counsel on loans originated under Fannie Mae’s Delegated Underwriting and Servicing (DUS)® loan product. Tim has closed Freddie Mac loans in every region of the country and has close relationships with Freddie Mac legal, production, underwriting, servicing, and management professionals. Additionally, he provides representation on a national basis and regularly manages the requirements and documentation of Fannie Mae programs. More >      

Commercial Real Estate Finance and Development

In real estate finance matters, Tim represents life insurance companies and banks, and leads transactions involving office, industrial, hospitality, retail, multifamily, and seniors housing projects.  He also represents borrowers in both acquisition financing and loan refinancing transactions. On the development side, Tim has experience with industrial, office, retail, and multifamily projects. More >  

Real Estate Leasing, Purchases, Sales, and Title Resolution

Tim represents landlords and tenants in negotiating and preparing lease documentation for retail, office, industrial, and warehouse space. He also works with buyers and sellers in all phases of the purchase and sale of residential and commercial real estate – from negotiations, to due diligence and document preparation, and through closing. In addition, he regularly identifies and resolves title and survey issues and negotiates title insurance coverage for a range of clients. More >

Professional Leadership

Tim has been selected to serve on the Freddie Mac Multifamily Legal Advisory Council. In that role, he works with Freddie Mac's legal division to update and improve legal documentation and loan requirements to address legal and industry developments. Tim also serves on Moss & Barnett's board of directors.
